Text:"The proposal by Szlachetko (2001) to elevate the Caladenia section Phlebochilus to generic status is similarly flawed, as he again failed to cite a type and none was cited earlier by Bentham (1873) when he first described the taxon. Since Szlachetko did not directly refer to the accounts of this taxon by either Hopper and Brown (2000) or Jones (2001), both identifying Caladenia cairnsiana F.Muell. as the type, their choice is not relevant to his validation of the proposed genus Phlebochilus."
Comment:Jones et al. (2001) state that Phlebochilus (Benth.) Szlach. had not been validly published because Szlachetko (2001) did not indicate the type species of the new genus. Jones et al. cite ICBN Art. 37.1 (St Louis Code, 2000), which requires indication of the type of the name of a new taxon at the rank of genus or below for valid publication. However, as Szlachetko’s name is a new combination rather than that of a new taxon, this requirement does not apply and the genus is validly published.
Text:"In creating the genera Jonesiopsis and Phlebochilus Szlachetko failed to recognise that both genera were based on the same type species, C. multiclavia Rchb.f. Therefore both generic names are invalid according to ICBN, Art. 34.2, because Szlachetko inadvertently published two different generic names based on the same type in the same publication (actually on the same page)."
Comment:Jones & Clements (2005) state that neither Jonesiopsis Szlach. nor Phlebochilus (Benth.) Szlach. had been validly published because Szlachetko (2001) based both names on Caladenia multiclavia Rchb.f. as the type species. Jones & Clements cite ICBN Art. 34.2 (St Louis Code, 2000), which rules that two or more different names based on the same type proposed simultaneously for the same taxon by the same author are not validly published. However, Phlebochilus (Benth.) Szlach. had previously been typified using Caladenia cairnsiana F.Muell. by Hopper & Brown (2001). Also, Szlachetko did not propose two alternative names for the same taxon. Both genera are thus validly published.
