Text: "The proposal by Szlachetko (2001) to elevate the Caladenia section Phlebochilus to generic status is similarly flawed, as he again failed to cite a type and none was cited earlier by Bentham (1873) when he first described the taxon. Since Szlachetko did not directly refer to the accounts of this taxon by either Hopper and Brown (2000) or Jones (2001), both identifying Caladenia cairnsiana F.Muell. as the type, their choice is not relevant to his validation of the proposed genus Phlebochilus."
Comment: Jones et al. (2001) state that Phlebochilus (Benth.) Szlach. had not been validly published because Szlachetko (2001) did not indicate the type species of the new genus. Jones et al. cite ICBN Art. 37.1 (St Louis Code, 2000), which requires indication of the type of the name of a new taxon at the rank of genus or below for valid publication. However, as Szlachetko’s name is a new combination rather than that of a new taxon, this requirement does not apply and the genus is validly published.
